Nutri Foods — Terms of Service

Welcome to Nutri Foods ("Nutri," "we," "us," "our"), a sole proprietorship trade name based in Lahore, Punjab, Pakistan, operating the website nutrifoods.pk (the "Site") and selling food and grocery products (the "Products").

These Terms of Service ("Terms") govern your access to and use of the Site and any purchase you make through it. By creating an account, browsing the Site, or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Eligibility

There is no explicit minimum age requirement to use the Site; however, by placing an order you represent that you have the legal capacity under the laws of Pakistan to enter into a binding contract and that any payment method used belongs to you or you are authorized to use it.

2. Accounts

An account is required to place an order on the Site.

  • You must provide accurate, current, and complete information when creating your account.
  • You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
  • Nutri Foods is not liable for any loss arising from unauthorized use of your account, though we will take reasonable steps to assist if you report suspected unauthorized access.
  • We reserve the right to suspend or terminate accounts that provide false information, are used fraudulently, or violate these Terms.

3. Products & Product Information

  • We make reasonable efforts to ensure product descriptions, images, weights, and pricing on the Site are accurate. However, minor variations in packaging, appearance, or weight may occur, and colors/images may differ slightly from the actual product due to photography and screen display.
  • All products are subject to availability. Listing a product on the Site does not guarantee stock availability at the time of order.

4. Allergen & Health Disclaimer

  • Nutri Foods products may contain, or be processed in facilities that also process, common allergens including but not limited to nuts, tree nuts, dairy, gluten, soy, and sesame. Customers with food allergies or sensitivities must carefully review product labels and ingredient information before consumption.
  • Product descriptions and labels are provided for general informational purposes only and do not constitute medical or dietary advice.
  • Nutri Foods is not liable for any allergic reaction, adverse health event, or medical condition arising from the consumption of our products. Customers with known allergies, medical conditions, or dietary restrictions should consult a qualified physician or nutritionist before consuming any product purchased from the Site.
  • If you have questions about a specific product's ingredients or allergen content, please contact us before placing your order.

5. Pricing & Payment

  • All prices are listed in Pakistani Rupees (PKR) and are inclusive/exclusive of applicable taxes as indicated at checkout.
  • Prices are locked in once an order is confirmed. Nutri Foods reserves the right to change product prices, promotions, and discounts for future orders at any time and without prior notice.
  • We accept the payment methods listed at checkout, which may include Cash on Delivery (COD) and prepaid options (bank transfer, mobile wallets, and/or card payments as available).
  • In the event of a pricing error on the Site (e.g. due to a technical fault), Nutri Foods reserves the right to cancel the affected order, notify the customer, and issue a full refund of any amount paid.

6. Order Acceptance & Cancellation

  • Placing an order constitutes an offer to purchase; it does not guarantee acceptance.
  • Nutri Foods reserves the right to cancel or refuse any order, in whole or in part, at any time prior to dispatch, for any reason, including but not limited to stock unavailability, suspected fraudulent activity, pricing errors, or delivery-area limitations. Where an order is cancelled after payment has been made, a full refund will be issued.
  • Customers may request cancellation of an order before it has been dispatched by contacting us via the channels in Section 17. Once an order has been dispatched, it can no longer be cancelled and is subject to our Return & Refund Policy.

7. Delivery

  • Delivery timelines communicated at checkout or via order confirmation are estimates only and are not guaranteed.
  • Risk in the products passes to the customer upon delivery to the address provided at checkout. It is the customer's responsibility to ensure someone is available to receive perishable/food items promptly.
  • Nutri Foods is not responsible for delays caused by third-party courier partners, incorrect/incomplete addresses provided by the customer, or events outside our reasonable control (see Section 12).

8. Returns & Refunds

All returns, replacements, and refunds are governed by our separate Return & Refund Policy, which is incorporated into these Terms by reference. Given the perishable nature of our products, returns are limited and subject to strict conditions as set out in that policy.

9. Prohibited Use

You agree not to:

  • Use the Site for any unlawful purpose or in violation of any applicable Pakistani law or regulation;
  • Attempt to gain unauthorized access to the Site, other user accounts, or our systems;
  • Use automated means (bots, scrapers) to access or extract data from the Site without our written permission;
  • Submit false, fraudulent, or misleading information, including placing fraudulent orders or engaging in chargeback abuse;
  • Reproduce, resell, or commercially exploit any part of the Site or its content without our prior written consent.

We reserve the right to suspend or terminate access for any user found in violation of this section.

10. Intellectual Property

All content on the Site — including but not limited to the Nutri Foods name, logos, trademarks, product photography, packaging designs, graphics, text, and site layout — is the property of Nutri Foods and is protected under applicable Pakistani intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any Site content without our prior written permission.

11. Limitation of Liability

To the maximum extent permitted under the laws of Pakistan:

  • The Site and all Products are provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, beyond what is legally required.
  • Nutri Foods shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or health-related claims (subject to Section 4), arising out of or related to your use of the Site or consumption of our Products, even if advised of the possibility of such damages.
  • Nutri Foods' total aggregate liability for any claim arising from an order shall not exceed the amount actually paid by the customer for that specific order.
  • Nothing in this section limits liability that cannot be excluded or limited under mandatory provisions of Pakistani law.

12. Force Majeure

Nutri Foods shall not be held responsible for any delay or failure to perform its obligations under these Terms where such delay or failure results from causes beyond our reasonable control, including but not limited to natural disasters, floods, fires, strikes, labor disputes, government actions or restrictions, power or internet outages, courier/logistics disruptions, or other events of force majeure.

13. Dispute Resolution

In the event of any dispute arising out of or relating to these Terms or your use of the Site, the parties agree to the following escalation process before pursuing litigation:

  1. Negotiation: The parties shall first attempt to resolve the dispute through good-faith direct negotiation.
  2. Mediation: If unresolved within a reasonable time, the parties shall attempt to resolve the dispute through mediation.
  3. Arbitration: If mediation fails, the dispute shall be referred to arbitration in Lahore, Pakistan, in accordance with the applicable arbitration laws of Pakistan.
  4. Courts: Only if the above steps fail to resolve the dispute may either party pursue litigation.

14. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Islamic Republic of Pakistan, including applicable provincial consumer protection legislation. Subject to Section 13, the courts of Lahore, Punjab shall have exclusive jurisdiction over any disputes arising from these Terms.

15. Amendments

Nutri Foods reserves the right to update or modify these Terms at any time, at our sole discretion. Changes are effective immediately upon being posted to the Site. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms. We encourage customers to review this page periodically.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable under applicable law, that provision shall be modified to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
